The short version
- Stackscape is free to play. Please play fair and don't cheat, hack or copy the game.
- Coins, themes and skins are for fun inside the game. They have no real-world money value.
- The game is provided "as is". We work hard on it, but we can't promise it will never have bugs.
- Your privacy is covered in our Privacy Policy.
1. Agreeing to these terms
These Terms of Service ("terms") are an agreement between you and Axieo Technologies Inc. ("Axieo", "we", "us"), a company based in Ontario, Canada. They cover the Stackscape game on any device (the "game") and the website stackscape.app (the "website"), together the "services". By downloading, installing or playing the game, or using the website, you agree to these terms. If you don't agree, please don't use the services.
2. Who can play
Stackscape is made for players aged 13 and older. If you are under the age of majority where you live, you confirm that a parent or guardian has read and agreed to these terms with you.
3. Your license to play
We give you a personal, limited, non-exclusive, non-transferable, revocable license to install and play the game on devices you own or control, for your own non-commercial entertainment, following these terms and the rules of the store you downloaded it from.
You may not: copy, sell, rent, sublicense or distribute the game; decompile, reverse engineer or modify it, except where the law allows this despite this restriction; remove copyright or other notices; or use the game, its art, music or code to make another product.
4. Coins, themes, skins and other items
- The game has virtual items such as coins, themes, block skins, sky skins, streaks and achievements ("virtual items").
- You earn virtual items by playing, or by choosing to watch a rewarded ad. Virtual items are licensed to you as part of the game; you don't own them.
- Virtual items have no real-world monetary value and cannot be exchanged for money or anything else of value, sold, or transferred outside the game.
- We may change how virtual items are earned or priced, for example to balance the game.
- Progress is saved on your device. If you uninstall the game or lose your device without using cloud save, your progress and virtual items may be lost and we can't restore them.
5. Purchases
The game is free to download. If we offer an in-app purchase (such as removing ads), it is sold through Google Play or the Apple App Store, and their terms for payment and refunds apply. Refund requests go to the store you bought from. A purchase applies to your store account; use "Restore purchases" in the game to restore it on a new device. Nothing in these terms affects rights you have under consumer protection law.
6. Ads
The game shows ads provided by Google AdMob. We set limits so ads never appear during play, but we don't create or control the ads themselves. We aren't responsible for the products, services or websites that advertisers promote, and any dealings you have with an advertiser are between you and them. How ads use data is explained in our Privacy Policy.
7. Fair play
Leaderboards and the Daily Tower are only fun if everyone plays fair. You agree not to:
- use cheats, bots, automation, modified versions of the game, or tools that change how it works;
- exploit bugs or glitches, or manipulate your device's clock or data to gain coins, streaks or scores;
- interfere with or try to get unauthorized access to the game, our servers, or other players' data;
- use a display name that is offensive, misleading, or infringes someone else's rights (on services where you choose a name).
We may remove scores or virtual items gained unfairly, and may suspend features for players who break these rules.
8. Other services
Optional features use services run by other companies, such as Google Play Games and Apple Game Center for sign-in, leaderboards, achievements and cloud save. Your use of those services is governed by their own terms and privacy policies, and we aren't responsible for them.
9. Ownership
The game and the website, including the Stackscape name and logo, code, art, music, sounds and text, are owned by Axieo Technologies Inc. or its licensors and are protected by copyright, trademark and other laws. Some parts, such as the Fredoka font and open-source libraries, are used under their own licenses, listed in the game under Settings → Licenses. All rights not expressly granted to you are reserved.
If you send us ideas or feedback, you agree that we may use them freely without paying you or giving credit.
10. Changes and availability
We keep improving Stackscape, so we may add, change or remove features, content or virtual items. We may also stop offering the game, in which case we'll try to give reasonable notice. Some features need an internet connection and may be unavailable at times.
We may update these terms. We'll change the date at the top of this page, and for important changes we'll let you know in the game or the store listing. If you keep playing after the change takes effect, the new terms apply.
11. Ending these terms
You can stop at any time by uninstalling the game. We may suspend or end your license if you seriously or repeatedly break these terms. Sections 4, 9, 12, 13, 14 and 17 continue after these terms end.
12. Disclaimer
To the fullest extent the law allows, the services are provided "as is" and "as available", without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. We don't promise that the services will be uninterrupted, error-free or free of harmful components, or that your progress will never be lost.
Some places don't allow these exclusions, so some of them may not apply to you. Where you have consumer rights that can't be excluded, nothing in these terms takes them away.
13. Limits on liability
To the fullest extent the law allows, Axieo and its directors, employees and partners won't be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, data, progress or virtual items, arising from your use of the services. Our total liability for any claim about the services is limited to the greater of the amount you paid us in the 12 months before the claim, or CAD $50.
These limits don't apply to liability that can't be limited by law, such as for fraud, or for death or personal injury caused by negligence.
14. Governing law and disputes
These terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply there, without regard to conflict-of-law rules. Any dispute will be handled by the courts located in Ontario, Canada, and you and we agree to their jurisdiction. If you are a consumer living elsewhere, you keep any protections that the laws where you live give you and that can't be waived by agreement, including the right to bring a claim in your local courts.
Before starting a formal dispute, please email us at support@stackscape.app. Most problems can be fixed quickly that way.
15. Apple App Store terms
If you downloaded the game from the Apple App Store, these extra terms apply:
- These terms are between you and Axieo only, not with Apple Inc. ("Apple"). Axieo, not Apple, is solely responsible for the game and its content.
- Your license is limited to using the game on Apple-branded products that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions, except that the game may also be accessed by other accounts associated with you through Family Sharing or volume purchasing.
- Apple has no obligation to provide any maintenance or support for the game.
- If the game fails to meet any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) you paid for the game. To the fullest extent the law allows, Apple has no other warranty obligation with respect to the game; any other claims, losses, liabilities, damages, costs or expenses due to a failure to meet a warranty are Axieo's responsibility, to the extent not disclaimed in these terms.
- Axieo, not Apple, is responsible for addressing any claims by you or a third party relating to the game or your possession or use of it, including product liability claims, claims that the game fails to meet any legal or regulatory requirement, and claims under consumer protection, privacy or similar laws.
- If a third party claims that the game or your possession and use of it infringes their intellectual property rights, Axieo, not Apple, is solely responsible for the investigation, defense, settlement and discharge of that claim.
- You confirm that you are not located in a country that is subject to a Canadian or U.S. Government embargo, or that has been designated as a "terrorist supporting" country, and that you are not listed on any Canadian or U.S. Government list of prohibited or restricted parties.
- Questions, complaints or claims about the game go to Axieo using the contact details below.
- Apple and its subsidiaries are third-party beneficiaries of these terms, and once you accept these terms, Apple will have the right (and will be deemed to have accepted the right) to enforce them against you as a third-party beneficiary.
16. Google Play terms
If you downloaded the game from Google Play, your use is also subject to the Google Play Terms of Service. Google is not a party to these terms and is not responsible for the game.
17. General
These terms, together with the Privacy Policy, are the whole agreement between you and us about the services. If any part is found unenforceable, the rest stays in effect. If we don't enforce a part right away, we haven't given up the right to do so later. You may not transfer these terms to anyone else; we may transfer them as part of a merger, acquisition or sale of assets. If these terms are translated, the English version controls where the law allows.
